How do I know if I have a lemon?
  •  The California Lemon Law says the manufacturer is allowed a reasonable number of repair attempts to fix a substantial defect before your car is considered a lemon.
  •  There is no magic number on how many times you must take your car in before you can file your Lemon Law claim.
  • Every case is unique and will be evaluated based on several factors including: the issues you’re experiencing, how many times you’ve taken it to the dealership for repairs, the mileage at each visit, how many days it was at the dealership, and several others.

I have taken my car in a few times, but for different issues. Does that count?

CA Lemon Law does not require all your visits to be based on the same defect. Although repeat visits for the same defect may make your case stronger, you may still qualify for compensation if all visits are for different issues. There are several factors we use when evaluating the strength of your possible case.

What will this cost me?

I leased my car, do I still qualify?

Yes! Under CA lemon law, with a new lease you have the same rights as if you purchased the vehicle. 

What if I bought my car used?

You might still qualify! CA Lemon Law applies to both new and used vehicles. For your used vehicle to apply, you must:

1) have bought your vehicle from a California dealership (mom and pop dealerships count!); and

2) complained about your issues to an authorized dealership during the original manufacturer warranty period.

Do I really need an attorney?

My car is out of warranty now. Can I still pursue a case?

You may still have a claim if you took your car in for repairs while it was still covered under the manufacturer warranty. The Lemon Law does not focus on the current warranty status, but on the warranty repair history. 

I already got rid of my vehicle, is there anything I can still do?

Great news! You do not have to still own your vehicle to pursue a claim. If you meet the warranty repair requirements, we can still help even if the vehicle is long gone. Contact us right away to see how we can help still. 

What do I get if my car is a Lemon?

If your vehicle meets the requirements under the Lemon Law, you may be entitled to reimbursement for what you paid for your vehicle (less a few deductions allowed under the law). In some cases, we are also able to negotiate a replacement vehicle or a cash settlement. 

What do I need to do?
  • If you notice any issues with your vehicle and you are still under manufacturer warranty, take it in the dealership as soon as possible. Calling and telling them about your issues is not enough. You must take it in to get looked at.
  • Be sure you keep copies of your documents from the dealership. If you already discarded them, request copies right away, but do not tell them what it is for. Contact our office to see if your vehicle qualifies for compensation.
